1. By entering the competition (the “Competition”) you agree to these terms and conditions.


2. This Competition is open to residents of the UK aged 16 or over, except for employees of the Arcadia Group, their families, agencies or anyone else associated with this Competition. If you are under the age of 18, you must obtain consent from your parent/guardian to enter the Competition. By entering into the Competition you confirm that you have this consent.


3. To enter you must create and draw a rainbow design for a white Evans t-shirt on an in store entry form or download an entry form online at and scan and upload the complete form to the Evans webpage, or hand it to a member of staff in store. The Competition opens at 09.00 (GMT) on Saturday 1st April 2017 and closes at 23.59 (GMT) on Sunday 30th April 2017 (the “Closing Date”). Entries must not be sent in through agents or third parties. Late, incomplete, illegible or defaced entries will not be accepted.


4. There shall be one winner (the “Winner”). The winning entry will be the entry which, in the sole opinion of Evans and Rainbow Trust is the most original design for the t-shirt. The Winner will be notified by phone or email no later than 1 week after the Competition has closed. The decision of Evans and Rainbow Trust shall be final and binding in all respects on all entrants. No correspondence will be entered into.


5. There is one prize (the “Prize”) to be won. The Prize shall consist of: a) A £100 Evans gift card to use online or in store. Gift card terms and conditions apply; and b) The winning design will go into production and will be sold in Evans in July 2017, in store and online. The Winner acknowledges that no further fee or remuneration is due or may become due to the Winner in respect of this Clause 5b). The profit made from the sale of the t-shirts will go to Rainbow Trust.


6. If the Prize is not accepted within 5 days of the Winner being notified, Evans reserves the right to award the Prize to an alternative winner.


7. The Prize is non-transferable, non-refundable and non-negotiable. There is no cash alternative. Evans reserves the right to substitute the Prize (or any part thereof) for one of its choosing which has a value the same or greater than the original prize in the event of circumstances outside of its control.


8. Only one entry per person. Any person found to be sending multiple entries will be ineligible. Evans does not accept responsibility for network, computer, hardware or software failures of any kind, which may restrict or delay the sending or receipt of your entry.


9. Subject to Clause 10 below, you will retain the rights of ownership in your design (“Entry”). However, in consideration of Evans providing the Competition, you will grant Evans a worldwide, irrevocable, royalty-free licence to use your Entry in any of Evans’ publications, websites, promotional activities and any other materials, for 50 years from the closing date of the Competition. To the maximum extent permitted by law, you hereby agree to waive all, and agree not to assert any, of your moral rights (or similar rights) wherever in the world arising which relate to your Entry. All material submitted becomes the sole property of Evans and will not be returned.


10. If you are the Winner, you agree that you will assign to the Promoter, with full title guarantee and free from all third party rights, the intellectual property rights and all other rights in your Entry (the “Assignment”). The Winner agrees to promptly, at the Promoter’s request, execute any document as the Promoter may require for the purpose of securing the full benefit of the Assignment. If the Winner does not agree to enter into this assignment, the Promoter reserves the right to award the Prize to an alternative winner.


11. All Entries must be your own work and must not have been published elsewhere or have won a prize in any other similar competition. It is your responsibility to ensure that any Entry does not infringe the intellectual property rights or other rights of any third party or any laws. You warrant that the Entry is your own work and that you own the intellectual property rights in it.


12. By entering this Competition, you agree that your details, including but not limited to your email address, may be used to keep you informed about Evans promotions, products and news. Evans complies with the standard procedures laid down in the UK Data Protection Act to ensure that the personal information you give us is kept secure and processed fairly and lawfully. Evans will not share your information with third parties for marketing purposes unless you have given us permission to do so. 13. By entering the Competition, the Winner agrees to participate in such promotional activity and material as Evans may require.


14. The Winner’s first name, surname and county will be available for 28 days after the Closing Date and can be requested by sending a stamped addressed envelope to “Evans Design a T-Shirt competition” at the address below.


15. Evans reserves the right to (i) cancel this Competition, (ii) cancel or refuse any individual’s entry and (iii) amend these terms and conditions (and will use reasonable endeavours to notify changes to entrants and potential entrants). These terms and conditions shall be governed by English law and the English courts shall have exclusive jurisdiction in the event of a dispute.
